Can I get legal aid as I'm on low income?
If you are considered a ‘proven victim of domestic abuse’ or your child is at risk of harm, you may qualify for legal aid. There is also a financial test that will apply. Cader Solicitors does not offer legal aid, however we do offer payment plan depending on the nature of your case.

The family home is owned in my spouse's name do I have any rights?
No. If you are married or in a civil partnership you will have a financial interest as the family home will be considered a matrimonial asset. You can apply to protect your interest in the family home by registering a Notice of Home Rights.

What is family mediation and how does it work?
There are times in disputes where neither side can make progress. Just as in a TV debate, there’s a need for a moderator, or in this case, somebody to act in a way to help facilitate a more constructive discussion. Family mediators act as an impartial facilitator.

What is a parenting plan and who is it for?
Divorced or separated parents often benefit from a parenting plan, outlining co-parenting principles and child-related arrangements. The Children and Family Court Advisory and Support Service (Cafcass) offers a template for this plan. In cases of strained parent relationships, family mediation is an option for resolving plan details.

I’m concerned for my children what can I do?
Stay objective. Why do you worry about your ex's care for your kids? If it's safety concerns, discuss them. For serious worries about your child's welfare or safety, consult a legal expert. If you believe your child's safety is at risk, contact the local Children's Services. Speak to us for guidance and court applications.

Will I need a court order to see my children?
When parents can't agree on child visitation, court involvement may become necessary. We explore alternatives: solicitor-led negotiation, mediation, counselling, and parenting courses to promote cooperation. We aim to resolve without court intervention, but in high-conflict cases, we'll advocate in court on your behalf.
