The process of obtaining a divorce in the United Kingdom, legally speaking, is relatively uncomplicated, especially if both you and your partner have mutually decided that the marriage has come to an end.

Divorce can feel overwhelming, but the law has changed to make the process simpler and less confrontational. Since April 2022, the no-fault divorce system allows couples to end their marriage without assigning blame, reducing conflict and helping you move forward with confidence.

What Is No-Fault Divorce?
The no-fault divorce system removes the old requirement to prove adultery, unreasonable behaviour, desertion, or long periods of separation.
Now, you simply need to confirm that the marriage has irretrievably broken down.

Are You Eligible for a Divorce?
You can apply for a divorce in England or Wales if:
You have been married for at least one year, and
You believe the marriage has permanently broken down.
No further reasons or evidence are needed.

How to Start the Divorce Process
A divorce begins by submitting an online divorce application through the Family Court.
You can apply:

Individually (a sole application), or
Together with your spouse (a joint application)
Our team can prepare and submit the application on your behalf, ensuring everything is completed correctly from the start.
What Happens After You Apply?
Once the application is issued, the Court will send the divorce documents to your spouse (the Respondent) if you are applying alone.
They confirm receipt by completing an Acknowledgment of Service.
If they do not respond, alternative methods of proving service - such as a statement from a process server - may be used.
Under the no-fault system, your spouse cannot normally contest the divorce, except in very limited and technical circumstances (such as jurisdiction).
All divorces include a 20-week waiting period between issuing the application and applying for the next stage.
This allows time for reflection and for both parties to plan any financial or child arrangements.
We help you use this period productively so your case can progress smoothly.
Step 2: Conditional Order
After 20 weeks, you can apply for a Conditional Order (previously known as the Decree Nisi).
This confirms that the Court sees no reason why the divorce cannot proceed.
We will prepare the application and ensure that all procedural requirements have been met.
Step 3: Final Order – Your Divorce Is Complete
Six weeks and one day after the Conditional Order, you may apply for the Final Order, which formally ends the marriage.
Once granted, you are legally divorced.
