How easy is getting a divorce?
The process of obtaining a divorce in the United Kingdom, legally speaking, is relatively uncomplicated, especially if both you and your partner have mutually decided that the marriage has come to an end.
Complexities tend to emerge when addressing practical matters such as living arrangements, childcare, and financial settlements.
Our experts in divorce, under the leadership of Sophina, comprehends that divorce is not merely a legal procedure; it's a transformative life event. We adhere to the Resolution philosophy of family law, which advocates for amicable resolutions in family matters, minimizing the need for court involvement.
In order to secure a divorce in the UK, certain prerequisites must be met. These include having a marriage that has lasted for a year or longer and demonstrating that the marriage has reached a point of 'irretrievable breakdown' due to one of the subsequent reasons:
Adultery
Unreasonable behaviour
Desertion
Separation for two years or more with mutual consent from your spouse Separation for a period of five years or more

The divorce process in England & Wales

Petition of divorce & service of documents
After you have determined the legal basis for divorce, you are required to submit a divorce petition to the Family Court and formally notify your estranged spouse, referred to as the Respondent. This notification can be accomplished either through personal delivery or postal service.
To the Court's satisfaction, you must provide evidence of this notification, typically in the form of an Acknowledgment of Service Form signed by the Respondent or their legal representative. Alternatively, a statement from a process server affirming that the Respondent has received the necessary documents will also be acceptable.
In the UK, the number of contested divorces is exceedingly low, and even fewer of them result in successful defenses. Should the Respondent opt to contest the divorce, they are obligated to submit a response addressing the divorce grounds stated in the petition, adhering to the specified timeframe.

In cases where the divorce remains uncontested and all procedural obligations are fulfilled, the District Court Judge will grant approval for the petition to proceed towards obtaining a Decree Nisi.
